Termite Terms and Conditions

Retreatment Guarantee:

 In consideration of sums received by Forrest Exterminating Service, Inc. for providing treatment of Eastern Subterranean Termites, shown on graph of the premises specified in the agreement, we guarantee:  

To inspect the structure(s) treated as described in said Service Order.

 To apply any necessary additional treatment to such structure(s), at no extra cost, if infestation of subterranean termites is found in the structure(s) during the period covered by this guarantee.

 Terms and Conditions:

 The initial period of this Guarantee shall commence on the date of the initial treatment shown above. In addition to this initial period, the customer may thereafter renew this Guarantee annually. The Guarantee will be renewed annually upon receipt by Forrest Exterminating Service, Inc. (hereinafter known as “the Company”) of the above stated annual renewal premium on or before the renewal date of each subsequent year.

 The Company reserves the right to adjust the annual renewal premium after the fifth year of the original treatment date.

 Upon receipt of the annual renewal payment each year, the Company will inspect the covered structure(s). If the annual renewal payment is not made on or before the renewal date of any subsequent year, this Guarantee shall terminate as of the renewal date on which said payment is due.

 This Guarantee covers the treated structure(s) as of the date of actual treatment. In the event the covered structure(s) is structurally modified, altered, or otherwise changed after the date of the initial treatment, this Guarantee shall terminate unless a prior written agreement has been entered into by the Company to re-inspect the structure(s), provide additional treatment where necessary and/ or adjust the annual renewal premium.

 The additional terms and conditions on the reverse side of this document are expressly applicable to this Guarantee. The customer acknowledges actual receipt of the terms and conditions on the reverse side of this document and agrees and understands that these additional terms and conditions form an essential and integral provision of the Guarantee binding the customer and the Company.

Terms and Conditions for RETREATING GUARANTEE

 This Agreement applies to the control of Eastern Subterranean Termites only. It is understood that subterranean termite feeding activity may continue up to 90 days after treatment.

Forrest Exterminating Service, Inc. (hereinafter known as “the Company”) is not responsible for the repair of either visible damage or hidden damage whether listed on the attached inspection graph or not. Because damage may be present in areas that are inaccessible to visual inspection, the Company does not and cannot guarantee that damage disclosed on the inspection graph represents all of the damage. At the time of the inspection, customer agrees to clear all walls and baseboards in slab areas of stored items so the Company inspector can thoroughly inspect the structure(s). This Agreement does not provide for the repair of termite/ moisture or related damages regardless of the nature, cause or extent of the damages. Further, the property owner agrees to maintain the structure(s) free from moisture leaks, moisture damage, wood-to-soil contact, non-masonry materials or surfaces in contact with soil or ground masonry surfaces (such as patios, porches, decks, sunrooms, concrete slabs, garage door jambs, etc) and other conditions conducive to Subterranean Termite infestation.

Additions and/ or Alteration: This Agreement applies only to the structure(s) identified on the inspection graph as of the date of the initial application. In the event that the covered structure(s) is structurally modified, altered or changed, the property owner will notify the Company before alterations are made. The Company reserves the right to modify and/ or adjust the annual renewal premium.

Water Leakage: Water leaks and/ or structural moisture conditions in treated structures and leaks in interior areas or through the roof, walls, plumbing fixtures, windows, doors, chimneys or other areas not listed create conditions that render a structure highly susceptible to infestation from Subterranean Termites. Further, these conducive conditions allow for the development of “Aerial or Secondary Colonies” which exist independently of the original ground based colony. Therefore, the property owner agrees to maintain the structure(s) free from these moisture conditions by making timely repairs to the structure. These areas are not covered by the Property Owner’s Warranty until such time repairs are made and the Company has been provided the opportunity to re-inspect the areas and has agreed to provide such coverage in writing.

Access to the Property: The property owner agrees to provide complete access to the property for any purpose contemplated by this Agreement including, but not limited to, re-inspections where requested by the property owner or considered necessary by the Company.

Changes in Law or Economics: All services performed under this Agreement shall be rendered in accordance with the requirements of the Federal, State and local laws and regulations. In the event of changes in the existing laws or regulations, as it pertains to the services promised herein, or as economics dictate, the Company, at its discretion, reserves the right to revise the fee structure, annual renewal premium or terminate the agreement.

Disclaimer: Liability under this Agreement will be terminated if the Company is prevented from fulfilling its obligations under this Agreement by reasons of delay in transportation, shortages of fuel, and/or acts of God, or circumstances beyond the control of the Company. This Agreement does not cover and it is agreed that the Company is not responsible for present or future wood- destroying insects, other than as specified in this Agreement, moisture, fungus, or related causes.

Issuance of Guarantee to New Property Owner: This Guarantee may be transferrable to the new property owner upon written notification to and written acceptance by the Company designating the name of the new property owner and date of property transfer.

Annual Renewal Premium: The initial period of this Guarantee shall commence on the anniversary date of the initial treatment. The Guarantee will be renewed annually upon receipt by the Company of the above- stated annual renewal premium on or before the renewal date of each subsequent year.

  • The Company reserves the right to adjust the renewal after the fifth (5th) year from the original treatment. 
  • Upon receipt of the annual renwal payment each year, the company will inspect structure(s). If the annual renewal payment is not made on or before the renewal date of any subsequent year, this guarantee shall terminate on the renewal date on which said payment is due.

Cancellation: Either party may cancel this guarantee only at the end of any renewal period.

Booster Treatments: All termiticides will eventually deteriorate over time. It may be necessary to perform a booster treatment to continue coverage. This will be done at an agreed upon additional charge by the Company and property owner.

 

Control Guarantee

In consideration of sums received by Forrest Exterminating Service, Inc for providing treatment for Eastern Subterranean Termites for structure(s) shown on the graph at the premises specified in this agreement,  we guarantee:

To inspect the structure(s) treated, as described in the Service Order.

To apply any necessary additional treatment to such premises, at no extra cost, if infestation of subterranean termites is found in the structure(s) during the period covered by this guarantee.

To repair or replace any structural wood members damaged because of active subterranean termite infestation. No other structure is covered unless so stated. Total coverage for subterranean termite damage not to exceed $25,000.00 during the guarantee period.

Terms and Conditions:

Repairs will be covered under the following conditions:

1. The following areas are treated and documented by dates of treatment:

Living area,  Slab (       ), Crawl (       ) _________________, Garage _________________, Porch _________________, Exterior Perimeter _________________.

 2. No above ground moisture is present to sustain infestation in structure.

3. All non-masonry construction elements will be maintained at a minimum of 8” (eight inch) vertical/ horizontal clearance from any soil/ fill.

4. At the time of inspection, customer agrees to clear all walls and baseboards of stored items in slab areas so the Company inspector can thoroughly inspect the property. If access is not made available at time of inspection, the Company will not guarantee repairs.

The initial period of the Guarantee shall be for twelve (12) months from the renewal/ treatment date. The customer may thereafter renew a Control Guarantee which will be issued and may be renewed by the customer for an additional year. A Guarantee shall be renewed annually upon receipt by the Company of the annual renewal premium on or before the annual renewal date.

The Company reserves the right to adjust the annual renewal premium after the fifth year from the original treatment date. If the structure contains Exterior Insulation Finishing Systems (EIFS), the Guarantee shall convert to a retreatment only guarantee.

This Guarantee covers the structure(s) as of the date of actual treatment and in the event the structure(s) are structurally modified, altered or otherwise changed after the date of the initial treatment, this Guarantee shall terminate, unless a prior written agreement shall have been entered into by the Company to re-inspect the premises, provide additional treatment if necessary and/ or adjust the annual renewal premium.

If the above noted is a condominium, this Guarantee shall not cover any subterranean termite infestation/ damage originating from the common wall which adjoins another unit if that unit has not been made available for the regular scheduled annual inspection.

The Company assumes no responsibility for subterranean termite infestation/ damages originating from non-masonry/ ground contact (i.e. wooden deck, EIFS, wood or vinyl siding, garage door frame).

The additional terms and conditions on the reverse side of this document are expressly applicable to this Guarantee. The Customer acknowledges actual receipt of the terms and conditions on the reverse side of this document and agrees and understands that these additional terms and conditions form an essential and integral provision of the Guarantee binding the customer and the Company.

CONTROL GUARANTEE 

This Agreement applies to the Control of Eastern Subterranean Termites only. It is understood that subterranean termite feeding activity may continue for up to 90 days after treatment. Once termite control has been established, the treated structure(s) may be eligible for up to $25,000.00 in subterranean termite damage repairs.

Because damage may be present in areas that are inaccessible to visual inspection, the Company does not and cannot guarantee that the damage disclosed on the inspection graph represents all of the damage present as of the date of the annual inspection. At the time of inspection, customer agrees to clear all walls and baseboards of stored items so the Company inspector can thoroughly inspect the property. If access is not made available at the time of inspection, the Company will not guarantee repairs. This Agreement does not provide for the repair of moisture or related damages regardless of the nature, cause or extent of the damages. Further, the property owner agrees to maintain the property free from moisture leaks, moisture damage, wood-to-soil contact, non-masonry materials or surfaces  in contact with soil or ground masonry surfaces (such as patios, porches, decks, sunrooms, concrete slabs, garage door jambs etc.), and other conditions conducive to subterranean termite infestation. It is understood and agreed that when termite and moisture damage is located in the same general or adjacent areas, that the moisture damage preceded the termite damage and the Company shall not be responsible for the repair of either and will not be covered under this warranty.

Additions and/or Alterations: This Agreement applies only to the property identified on the inspection graph as of the date of the initial application. In the event that the covered structure(s) is structurally modified, altered or changed, the property owner will notify the Company before alterations are made. In the event of structural modification, the Company reserves the right to modify and/or adjust the Annual Renewal Premium.

Notice of Claims & Access to the Property: Any claim made under this Agreement shall be made in writing to the Company prior to any modifications or repairs. The property owner agrees to provide complete access to the structure(s) for any purpose contemplated by this Agreement including, but not limited to, re-inspections where requested by the property owner or considered necessary by Forrest Exterminating Service, Inc.

 Changes in Law or Economics: All services performed under this agreement shall be rendered in accordance with the requirements of the Federal, State and local laws and regulations. In the event of changes in the existing laws or regulations, as it pertains to the services promised herein or as economics dictate, the Company, at its discretion, reserves the right to revise the fee structure of the annual renewal or terminate the agreement.

Disclaimer: Liability under this Agreement will be terminated if the Company is prevented from fulfilling its obligations under this Agreement by reasons of delay in transportation, shortages of fuel, and/or other acts of God, or circumstances beyond the control of the Company. This Agreement does not cover and it is agreed that the Company is not responsible for:

  •  Damage resulting from insects other than as specified in this Agreement, moisture, fungus or related causes.
  •  Damage resulting from masonry failure or grade alterations, wood or Exterior Insulation Finishing Systems (EIFS) in contact with the soil.
  •  Damage to fences, attached and detached, landscaping, etc., unless expressly stated in the original agreement.

Issuance of Guarantee to New Property Owner: A retreatment only guarantee may be issued to a new property owner upon written notification to and written acceptance by the Company designating the name of the new property owner and date of property transfer.
